Terms of service

These terms apply to FOUNDLY Radar (“Radar”), provided by FOUNDLY – Liam Valica, Au bei Turnau 33, 8624 Au bei Turnau, Austria (“we”, “us”). By creating an account you agree to them and to our Acceptable use policy.

1. Businesses only

Radar is offered exclusively to businesses, freelancers and other professionals acting for their trade or profession. It is not offered to consumers. By signing up you confirm you are using Radar for business purposes.

2. What Radar does

Radar lets you search a database of businesses that have no website, unlock their public business contact details, prepare outreach messages, create website preview pages (“mockups”) and proposals, and track your sales pipeline.

Business data comes from third-party sources, mainly the Foursquare Open Source Places dataset. It can be incomplete, outdated or wrong — for example, a business may already have a website. We don't guarantee accuracy, and we don't guarantee that you will win clients or make sales.

3. Accounts and team seats

4. Trial, plans and credits

5. Cancellation and refunds

You can cancel at any time under Billing → Manage billing. Cancellation takes effect at the end of the current billing period; you keep access until then. If you cancel a first yearly subscription within 14 days of paying and have used fewer than 100 credits, we refund it in full on request. Otherwise payments are non-refundable unless the law requires it.

6. Your outreach is your responsibility

You decide whom you contact, how and with what message. You must follow the laws on marketing communications and data protection in your country and in the country of the business you contact, and our Acceptable use policy. Radar's country rules, consent records and opt-out tools help you, but they are not legal advice and don't replace your own responsibility.

For contact details you unlock and use, you act as an independent controller under the GDPR. You must honour objections and opt-outs immediately.

7. Your content

Notes, mockup texts, proposals and branding you add remain yours. You give us the right to store and display them as needed to run Radar (for example, showing your mockup page to the business you send it to). Don't upload content you don't have the rights to.

8. Our rights

The Radar software, design and brand belong to us. Business data from Foursquare Open Source Places is used under the Apache License 2.0. You may not copy, resell or redistribute the database or build a competing dataset from it.

9. Availability and changes

We aim to keep Radar available but don't guarantee uninterrupted service; maintenance may cause short interruptions. We may improve or change features. We'll give at least 30 days' notice by email of material changes to these terms or to paid features; if you don't agree, you can cancel before the change takes effect.

10. Suspension

We may suspend or close accounts that breach these terms or the Acceptable use policy, especially for spam, ignoring opt-outs or misusing data.

11. Liability

We are fully liable for intent and gross negligence, for injury to life, body or health, and where liability cannot be limited by law. Otherwise, our total liability is limited to the fees you paid us in the 12 months before the claim, and we are not liable for lost profits, lost sales or indirect damages. You are liable for, and will indemnify us against, claims arising from your outreach or from breaking these terms.

12. Law and jurisdiction

These terms are governed by the laws of Austria, excluding the UN Convention on Contracts for the International Sale of Goods. Courts in the competent court at the owner's place of business (Austria) have jurisdiction for disputes with business customers.
